    Former Detroit Deputy Mayor Kandia Milton gets prison

    Former Detroit Deputy Mayor Kandia Milton was sentenced to 14 months in prison today for his role in a bribery scheme involving the $3.5-million sale of city-owned Camp Brighton to the Chaldean Catholic Church in 2007.

    The sentence was four months less than prosecutors recommended.

    U.S. District Judge Gerald Rosen said that unlike many of the defendants who have come before him, Milton, then the liaison to the Detroit City Council for ex-Mayor Kwame Kilpatrick, was truly remorseful for his conduct.

    Milton, 39, had bargained in a plea deal for 37 to 46 months in prison, but prosecutors recommended 18 to 23 months because of his substantial assistance in the investigation.

    Milton’s lawyer, Elliott Hall, had asked Rosen to consider probation, but Rosen rejected that request because he said Milton had betrayed the public trust and contributed to the "cancer" of corruption that pervaded the city government.

    It’s yet more legal wrangling in the slain stripper mystery.

    The city of Detroit says a former bodyguard of ex-Mayor Kwame Kilpatrick should not be forced to answer questions about publicly released text messages, arguing opposing counsel might stray too far from what’s relevant.

    In a motion filed Sept. 17, city attorney John Schapka urged the court to reject in full a motion that seeks to compel the testimony of former bodyguard Loronzo Jones, who was instructed by Schapka at a July deposition not to answer any questions relating to publicly released text messages sent by or to him.

    Lawyers representing the family of Tamara Greene, the slain stripper rumored to have danced at a never-proven party at the Manoogian Mansion, argued that Jones was improperly instructed not to answer the questions, and, have asked the court to order him to do so. They noted that the city’s “unfounded instruction” involved a limited number of “wholly different text messages” that remain under seal.

    Moreover, they’ve also asked the court to order the city to pay for another deposition.

    Schapka is objecting both requests. He noted in his filing that while the city does not object to continuing Jones’ deposition so long as it is limited in scope to the texts, it does object to “a general continued deposition embracing matters unrelated to the questioned text messages.”

    Therefore, he concluded, the court should deny the request “in its entirety.”

    Greene, 26, was killed n a drive-by shooting in April 2003, some six months after she supposedly danced at a rumored but never proved wild party at the mayoral Manoogian Mansion.

    Her family is suing the city and Kilpatrick, alleging Detroit police sabotaged her murder investigation so that her killers couldn’t be caught.

Tennis courts have been built in one of the hangers, that used to have 100% occupancy, now the place down to 50 %. Bing is looking into the matter once WXYZ showed him their report.

    Detroit -- A federal judge has ordered one of ex-Mayor Kwame Kilpatrick's bodyguards to continue being deposed and face questions about text messages.

    The order from Chief U.S. District Judge Gerald E. Rosen was entered into the court's computerized docket Sunday and marks a minor victory for lawyers representing the family of Tamara "Strawberry" Greene, an exotic dancer who allegedly performed at a rumored Manoogian Mansion party.

    Loronzo Jones, a former Kilpatrick bodyguard, was instructed by city lawyer John Schapka not to answer questions at his deposition July 23 about certain text messages sent by or to him, according to an earlier motion.

    Schapka's instruction to Jones was based on an interpretation of the court's protective order governing text messages that haven't been made public. But the court later made clear to Schapka that questions could be asked about text messages released by the prosecutor.

    Rosen ordered the city and Greene's lawyers to "promptly arrange for and convene the continued deposition of Mr. Jones," according to court records.

    Schapka said the city would not object to continuing Jones' deposition as long as questions were limited to those text messages "and matters reasonably derivative therefrom," according to a court filing.

    Greene's family is suing Kilpatrick and the city, claiming the Detroit Police investigation into Greene's drive-by killing in April 2003 was quashed.

    The city and Kilpatrick's lawyer have filed motions for summary judgment. The motions are pending.

    I have been hoping and hoping Yatooma would have come up with something more concrete by now. Was the cover up by these buffoons and thugs that good? If there is a case, something better break soon. I hope there is some really explosive stuff that is sealed and Yatooma can prove his case. Right now, I don't see it. Not enough anyway, to get somebody convicted.

    Kwame Kilpatrick tried three times before he got his dad's attention.

    "Pop. Pop. Pop," he said, before Bernard Kilpatrick turned while filling out paperwork allowing the elder Kilpatrick to remain free on bond.

    The chance for father and son to be in the same room lightened what could have been an otherwise somber occasion, as the former Detroit mayor, his father and three other men were arraigned today in federal court on 38 charges ranging from bribery and extortion to fraud and tax evasion.

    Although the Kilpatricks were not allowed to converse during the arraignment, they later shared a table during a pre-trial conference held about a half-hour later in U.S. District Judge Nancy Edmunds' courtroom. At the table they laughed and chatted with fellow defendant Bobby Ferguson, a city contractor also indicted last month on public corruption charges.

    Derrick Miller, a longtime friend of the Kilpatricks and the city’s former chief administrative officer, and Victor Mercado, the city’s former water department boss, sat at another table and kept their eyes forward. They were also indicted by a federal grand jury on Dec. 15.

    Federal prosecutors have accused the men of forming what prosecutors described as the Kilpatrick Enterprise, contending the men shook down city contractors for bribes and jobs for Ferguson.

    All five men either pleaded not guilty or stood mute as a federal magistrate entered not-guilty pleas for them.

    I'm not waiting for this ruling with baited breath...but hopefully we'll learn a bit about whether restitutuion demands have any teeth.

    I'd like to see the ruling go in the City's favor, and fully force all profits from Kwhyme's book to go ONLY into the payback...and then if he chooses NOT to write it, perhaps he can get in trouble for holding back on even the potential to pay.

    And no parole before the Federal Trials begin...period. I cannot even believe they'd consider it!

    Gotta love M.L. Erick's sense of humor. From his blog on Freep.com:

    "Ferguson, whose expertise with the law includes spending time in federal prison, told Langton that Groner was the worst judge in Michigan. He then asked Langton if Groner shouldn't have dealt with the constitutional issue before moving on to the question of what to do with the book's proceeds."

    Langton agreed with Groner, by the way.

    I think Groner is frustrated because it is almost as if Kwame wants to stay in prison. Once again they go into Court with a half-baked agenda to be less than forthcoming while he's in prison for doing this exact same thing, after he was sent to jail for pleading guilty to doing the exact same thing before!

    Groner has practically threatened to put Kwame on the stand over this, as if to say "you know he's going to perjure himself again..."
